(“ANKA Investment GSYO”) acts as the data controller within the scope of the Law No. 6698 on the Protection of Personal Data (“KVKK”) regarding the personal data of users visiting its website. This Clarification Text is provided to inform users in accordance with the relevant legislation.

Purposes of Processing Personal Data

Personal data of users are processed for the following purposes:

  • Carrying out the necessary work by business units to enable relevant persons to benefit from the products and services offered by ANKA Investment GSYO,
  • Execution of the Company’s commercial activities and related business processes,
  • Planning and implementation of the Company’s commercial and/or business strategies,
  • Ensuring the legal, technical, and commercial security of the Company and the relevant persons in business relationship with the Company,
  • Customizing and promoting the products and services offered in line with the preferences, usage habits, and needs of the users

These processes are carried out in accordance with the personal data processing conditions set forth in Articles 5 and 6 of the KVKK.

Transfer of Personal Data

Personal data may be transferred to:

  • Company officials,
  • Business partners,
  • Legally authorized public institutions and organizations,
  • Private legal entities

in line with the purposes stated above and within the framework of Articles 8
and 9 of the KVKK.

Cases Where Explicit Consent is Not Required

In accordance with Article 5/2 of the KVKK, personal data may be processed
without explicit consent in the following cases:

  • Where it is explicitly provided for by law,
  • Where it is necessary to protect the life or physical integrity of a person who is unable to give consent,
  • Where it is necessary for the establishment or performance of a contract,
  • Where it is necessary for the data controller to fulfill its legal obligations,
  • Where the data has been made public by the data subject,
  • Where data processing is necessary for the establishment, exercise, or protection of a right,
  • Where processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject

Services provided by ANKA Investment GSYO may be evaluated within this scope.

Method and Legal Basis for Collecting Personal Data

Personal data are collected electronically and processed and transferred
based on the legal grounds specified in Articles 5 and 6 of the KVKK.

Rights of Data Subjects

Under Article 11 of the KVKK, data subjects have the right to:

  • Learn whether their personal data is processed,
  • Request information if their personal data has been processed,
  • Learn the purpose of processing and whether data is used in accordance with its purpose,
  • Know the third parties to whom personal data is transferred domestically or abroad,
  • Request correction of incomplete or inaccurate data,
  • Request deletion or destruction of personal data,
  • Object to outcomes arising against them through automated systems,
  • Request compensation for damages in case of unlawful processing

Application Method

Requests regarding these rights may be submitted through ANKA Investment GSYO’s communication channels. Applications will be evaluated and concluded within 30 days in accordance with the applicable legislation.
